The GDRP is the toughest privacy and security law in the world. Though it was drafted and passed by the European Union (EU), it imposes obligations onto organizations located anywhere in the world, so long as they target or collect data related to people in the EU. The regulation was put into effect on May 25, 2018. The GDPR will levy harsh fines against companies who violate its privacy and security standards, with penalties reaching into the tens of millions of euros.

According to the GDPR website, the less severe infringements could result in a fine of up to €10 million, or 2% of the firm’s worldwide annual revenue from the preceding financial year, whichever amount is higher.

The more serious infringements go against the very principles of the right to privacy and the right to be forgotten that are at the heart of the GDPR. These types of infringements could result in a fine of up to €20 million, or 4% of the firm’s worldwide annual revenue from the preceding financial year, whichever amount is higher.

Many companies in Switzerland believe that because the Swiss data protection law currently does not stipulate an obligation to appoint a data protection officer, they are not required to do so. BUT did you know that if you do not appoint a data prorection officer, your staff are required to register their files? Staff who are responsible for data processing, however, can be exempted from the registration of their files if they have nominated a data protection officer.

Any organization that processes personal data of people in the EU must comply with the GDPR. “Processing” is a broad term that covers just about anything... collection, storage, transmission, analysis, etc. “Personal data” is any information that relates to a person, such as names, email addresses, IP addresses, eye color, political affiliation, etc. Even if an organization is not connected to the EU itself, if it processes the personal data of people in the EU (via tracking and cookies on its website, for instance), it must comply.
